Terms of Service

These Terms of Service ("Terms") govern your use of Planet-Fall, the game and website at planet-fall.io and anywhere it is embedded (such as itch.io) (together, the "Service"). The Service is operated by Alexzander Raykher ("we", "us"). By playing, creating an account or otherwise using the Service, you agree to these Terms, to our End User License Agreement and to our Privacy Policy. If you don't agree, please don't use the Service.

1. Who can play

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may only use the Service with the permission of a parent or guardian, who agrees to these Terms on your behalf.

2. The game is in alpha

Planet-Fall is an early, in-development game. Features, balance and rules change often, sometimes without notice. Matches end and planets are replaced by design, and we may also reset, wipe or roll back game worlds, nations, statistics or accounts at any time, for example to fix bugs or rebalance the game. Nothing you build or earn in the game is guaranteed to last.

3. Price

The Service is currently free to play in your web browser. We plan to release Planet-Fall on Steam, and some versions, platforms or features may cost money in the future. If that happens, the terms of sale will be presented to you before you pay, and purchases through Steam are also subject to Valve's Steam Subscriber Agreement.

4. Guests and accounts

• Guests can play without an account. A guest's nation is tied to the browser it was created in. If you clear your browser's data or switch devices, you may lose access to it, and we can't recover it.
• Accounts need only a username and password. You are responsible for keeping your password secret and for everything done with your account. Tell us promptly at [email protected] if you think someone else has accessed it.
• There is currently no password recovery. We don't collect email addresses, so if you forget your password we may not be able to restore your account.
• Usernames must follow the rules of conduct. We may rename, reserve or reclaim usernames and nation names. For example, names containing "_DEV" are reserved for the developer, and a registered player's username can't be used by anyone else as a nation name.
• Accounts are personal. Don't sell, trade, share or transfer your account.

5. Rules of conduct

Planet-Fall is a game about war between nations, not between people. When you use the Service, you agree not to:

• harass, threaten, bully or abuse other players, or post hateful, racist, sexually explicit or otherwise offensive content in chat, usernames or nation names (including by disguising words to get around the filter);
• impersonate the developer, a moderator or another player;
• cheat, including by using bots, scripts, automation, modified clients or any exploit or bug to gain an unfair advantage (please report bugs to us instead);
• interfere with the Service or other players' enjoyment of it, including by flooding, spamming, or attempting to overload, crash, probe or break into our servers;
• try to access accounts, nations or data that aren't yours;
• use the Service for anything illegal, or to advertise or sell anything without our permission.

Strategy is allowed and expected: attacking, allying, breaking alliances and conquering other nations within the game's rules are part of the game.

6. Chat, names and other content you create

You are responsible for the chat messages, usernames and nation names you create ("Your Content"). You keep any rights you have in it, and you give us a worldwide, royalty-free license to host, display and distribute Your Content as part of running and promoting the Service. This includes, for example, showing a winning nation's name in the Hall of Fame or in screenshots and videos of the game. We automatically filter offensive words and may remove, mask or change any content at our discretion.

7. Moderation and termination

We may warn, mute, rename, suspend or permanently ban any player or account, reset their nation or statistics, or refuse service, if we believe they have broken these Terms or harmed the Service or its players. We may do this without notice. You may stop using the Service at any time, and you can delete your account yourself from the Stats window on the main menu, as described in the Privacy Policy.

8. Our intellectual property

The Service, including the game, its code, graphics, text, names and logos, belongs to us or our licensors and is protected by law. Your use of the game software is licensed, not sold, under the EULA. You may share screenshots and videos of your own gameplay, including in monetized videos and streams, as long as you don't suggest we endorse you.

9. Availability and changes

We try to keep Planet-Fall running, but we don't promise it will always be available, uninterrupted or error-free. We may change, pause or discontinue any part of the Service at any time.

10. Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROGRESS, GOODWILL OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US$10. Some places don't allow these limits, so they may not all apply to you; nothing in these Terms limits rights you have under consumer-protection law that can't be waived.

12. Indemnity

To the extent permitted by law, you agree to cover our reasonable costs and losses arising from claims by others caused by your breach of these Terms or by Your Content.

13. Changes to these Terms

We may update these Terms from time to time. The date at the top shows when they last changed. If a change is significant, we'll try to let players know, for example in the game. Continuing to use the Service after a change means you accept the new Terms.

14. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. Disputes will be handled by the courts of the State of Florida, United States, unless the law where you live gives you the right to bring a claim in your local courts.

15. General

If any part of these Terms is found unenforceable, the rest stays in effect. If we don't enforce a part of these Terms right away, we haven't given up the right to enforce it later. These Terms, the EULA and the Privacy Policy are the whole agreement between you and us about the Service.
